FDA Issues Draft Guidance on the Voluntary Labeling of Sesame

FDA issued a voluntary Draft Guidance for the labeling of sesame to "encourage manufacturers to clearly declare sesame in the ingredient list, when it is used as a “flavoring” or “spice” or when the common or usual name (such as tahini) does not specify sesame."

Sesame is not currently included in the group of eight major allergens specified in the regulation to be declared in clear terms if included on the label.  "The FDA does not have the authority to amend the eight major food allergens established by FALCPA; however, it has the authority under the Federal Food, Drug, and Cosmetic Act to require labeling for other food allergens not covered by the requirements in FALCPA."

This is a draft, so comments can be made by stakeholders.

This Week In Mislabeled Products for Week Ending October 30, 2020

Improperly Designed Label Issue - Russ Davis Wholesale of Wadena, Minnesota is recalling individual serving cups of Mixed Veggie Cup with Dip because it may contain undeclared Egg.  The issue was discovered by Quality Control team during a routine label audit, where egg was noted on the dressing ingredient and was not reflected on the finished product label.

More Print and Apply Label Issues - Whole Foods Market is voluntarily recalling select prepared Macaroni & Cheese products from stores across five states because they contain undeclared egg. 

Regular Breaded Halibut Put in Gluten-Free Box - Orca Bay Foods of Seattle, WA is recalling 4,450 lb. (356 cases) of 10 oz. retail box Trader Joe's brand Gluten Free Battered Halibut SKU 00503822, because it contains undeclared wheat and milk allergens.  The recall was initiated after it was discovered that product containing Wheat and Milk was distributed in packaging that did not reveal the presence of the allergens.

FDA Warning Letter - Inadequate Allergen Controls at Salad Kit Company

A California salad processor was issued a Warning Letter by FDA for not have an Allergen Preventive Control at the masterpack addition step (the point in the process where the add the packets of salad add-ons....like dressing, nuts, etc. In the case that required a recall, “[t]he incorrect masterpack (kit with dressing and other toppings) was unintentionally used during the production of the [Tuscan Herb Chopped Salad Kit,]” "The masterpack used held dressing that contained peanut butter and almond, cashew, and chow mein noodle (wheat) toppings" Not items that would be added to a Tuscan Herb Chopped Salad. The firm "indicated that the cause was that [the company] “did not have a robust enough verification process for product changeover.”

So FDA issued a Warning Letter for not identifying and implementing food allergen controls adequate to significantly minimize or prevent the hazard of undeclared allergens as evidenced by [the] firm using an incorrect masterpack in your Tuscan Herb Chopped Salad Kit. This masterpack addition error caused {the] product to contain undeclared major food allergens."

FDA Warning Letter - Inadequate Allergen Controls at Chip Factory

An Indiana potato chip manufacturer was issued a Warning Letter as part of an inspection in response to a recall.  The recall was issued "after being notified by consumers that cheddar cheese flavored chips were found in bags of Kroger brand Sweet & Mesquite BBQ Flavored Potato Chips"

The company was cited for having an inadequate Food Safety plan, specifically, the company "did not identify and implement food allergen controls at the seasoning step adequate to significantly minimize or prevent the hazard of undeclared allergens as evidenced by [the] firm using cheddar and sour cream flavored seasoning instead of barbecue flavored seasoning while producing Sweet & Mesquite BBQ Flavored Potato Chips".  

Basically, there was no substantial control to make sure the flavor added to the product matched the label on the bag in which the finished chips were packed.  A pretty easy preventive control to implement, and perhaps one the company did not see as necessary because a simple control had worked in the past.  Not this time.  A simple error could have been easily been avoided by raising this to the level of a preventive control.

This Week in Mislabeled Product for Week Ending August 7, 2020

Wheat Missing from Label - H-E-B is voluntarily issuing an all-store recall for Blue Cheese Salmon Burgers due to an undeclared allergen - wheat.  The package types would indicate that this was a print-and-apply label.

Almond Milk Contains Cashew - SmithFoods Inc. announced that it is voluntarily recalling 16-oz pint packages of Earth Grown Vegan Non-Dairy Almond Based Frozen Desserts because it may contain an undeclared cashew allergen. The recall was initiated following a consumer complaint. The company continues to go through root cause analysis and is conducting a detailed review of allergen controls within all aspects of operations and supply chain processes.   There has been one reported incident of an allergic reaction to date.

Variety Pack Package Misses Allergen - Evans Food Group Ltd., an Arlington, Texas establishment, is recalling approximately 3,796 pounds of ready-to-eat (RTE) pork skin products due to the product containing soy which is not declared on the product label.  The issue, discovered during a record review, found that one product contains soy – the red hot fried pork skins – is packaged in a variety pack that does not declare soy on the outside package display panel; however, soy is declared on the individual 1-oz. product label and is listed in the individual product’s list of ingredients.

Chicken Wing Packaging Misses Allergens - Zilk’s Plus Resources, LLC of Austin, TX announces a voluntary recall for select 12 oz bottles of Pluckers World Famous Wing Sauces because they may contain undeclared allergens. The recall was initiated after it was discovered that these products were distributed in packaging that did not adequately reveal the presence of soy-, wheat- or milk- containing ingredients in the affected products.

Bread Put in the Wrong Bag - The Essential Baking Company of Seattle, Washington is recalling 84 loaves of 32 oz. Sliced Columbia Bread, expiration date May 6.20, due to undeclared egg. The actual product in the bags may be 16 oz. Challah Bread which was mis-labeled as Sliced Columbia Bread and the label does not declare egg.

This Week in Mislabeled Products for Week Ending February 1, 2020

Chicken Soup Packed in Wrong Package, Allergen Missing  - Bakkavor Foods USA, Inc. is voluntarily recalling 840 units of Harris Teeter’s Fresh Food Market Mushroom Barley Soup, 16 oz with “SELL BY” date codes 03/09/20 because it may contain undeclared milk.  The recall was initiated after it was discovered that Chicken Wild Rice Soup containing Milk was distributed in Mushroom Barley Soup packaging that did not reveal the presence of Milk. The problem was discovered when a Harris Teeter employee was stocking store shelves and noticed the discrepancy.

Non-Dairy Creamers Can Contain Caseinate, a Dairy Protein And Must Be Declared as Milk - Beepa’s of Beloit, WI is recalling Goulash, because it may contain undeclared milk.  The recall was initiated after it was discovered that product containing Milk was distributed in packaging that did not reveal the presence of Milk in the sub ingredients of the non dairy creamer.

Pizza Packed in Wrong Package, Allergen Missing - Astrochef LLC., a Rockwall, Texas establishment, is recalling approximately 7,363 pounds of pepperoni stuffed pizza sandwich products because the product is mislabeled and contains undeclared soy, - the products are labeled as pepperoni stuffed pizza sandwich products but may contain meatball stuffed pizza sandwich products inside the package.  The problem was discovered when the firm received consumer complaints about products labeled as Mega Sandwich Pepperoni Stuffed Pizza that contained a meatball stuffed pizza sandwich product.

Rookie Error - Missing the Anchovies in the Worcestershire Sauce - Carso’s Pasta Company, a Lynnwood, Wash. establishment, sold 636 pounds of ready-to-eat (RTE) Swedish meatball products that were misbranded. The products contain anchovies (fish), which are not declared on the product label. A recall was not requested because it is believed that the products are no longer available for consumers to purchase. The problem was discovered by FSIS during routine label verification activities.

Supplier Cross Contact Issue Results in Undeclared Dairy - Jeni’s Splendid Ice Creams has initiated a voluntary recall of three batches of Cold Brew with Coconut Cream Non-Dairy Frozen Dessert pints because they may contain an undeclared milk allergen. The recall was initiated following receipt of a single customer complaint of an allergic reaction. From the Recall Notice..."We have isolated the issue to the sorbet swirl in the flavor. Our investigation is ongoing, but we strongly suspect that a dry ingredient, used only in this flavor, came into contact with dairy powder as the dry ingredient was being produced for us in a partner’s facility.”

Wrong Package Results in Missed Walnut Allergen -
Purely Elizabeth is initiating a voluntary recall of their Chocolate Sea Salt Probiotic granola due to a mislabeling error that has resulted in an undeclared allergen (walnuts) being present. This recall has been initiated because it has come to their attention that briefly during production, pouches of Chocolate Sea Salt Probiotic Granola were used to package Maple Walnut Probiotic Granola. All mislabeled pouches of granola were packed into master cases labeled as 8oz Maple Walnut Probiotic Granola.

Wrong Label on Hearing in Cream Sauce - Ducktrap River of Maine of Belfast, Maine is announcing a voluntary recall of Herring Center Cuts in Wine Sauce identified with sell by date Jul 29, 2020 because these products contain undeclared milk due to an incorrect label. While the product in the containers is Herring Center Cuts in Cream Sauce, which contains milk, the containers were mistakenly labeled with the Herring Center Cuts in Wine Sauce labels. Ducktrap initiated the recall after discovering the labeling mistake. Subsequent investigation indicates that the issue is limited only to the specific lot identified above.

Consumer Finds Noodles In a Product with No Noodles
- Kettle Cuisine Midco, LLC, a Lynn, Mass. establishment, is recalling approximately 200 pounds of ready-to-eat (RTE) lentil and beef soup products due to misbranding and undeclared allergens, the U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced today. The products contain egg and wheat. The problem was discovered when the company received a complaint from a consumer who reported finding noodles in their lentil and beef soup.

Wrong Package with Malted Balls Packed in Chocolate Covered Cashews Container
- Cargill is voluntarily recalling 39 one-pound bags of product incorrectly packaged as Wilbur Dark Chocolate Covered Cashews. Sold locally through the Wilbur Chocolate Store in Lititz, Penn., the bags are being recalled out of an abundance of caution because of a wheat allergen presence. Wilbur Dark Chocolate Malted Milk Balls were incorrectly labeled and packaged as Dark Chocolate Covered Cashews. The Malted Milk Balls contain wheat, which is not listed on the incorrect ingredient label. The Dark Chocolate Covered Cashews labels do, however, bear a “may contain wheat” statement.

Allergens in Sub-ingredients Missed on Label - Ruleau Brothers Inc. of Stephenson, MI, is recalling its 8 ounce containers of "Door County Whitefish Smoked Whitefish Pate" because they may contain undeclared allergens of Egg, Soy, and Anchovies.  The recall was initiated after it was discovered during an FDA inspection conducted under contract by the Michigan Department of Agriculture and Rural Development that the product’s labeling did not fully list all ingredients and sub-ingredients contained in the product. Some of these missing ingredients and sub-ingredients contained the allergens of Anchovy, Egg, and Soy.

Peanuts in the Chocolate Chip Cookies - JuJu Bakes, LLC, DBA The Cookie Dough Cafe of Bloomington, IL is recalling 15 cases of 1.6 ounce Chocolate Chip Chilled Gourmet Edible Cookie Dough Bars, because they may contain peanuts.  Allergen issue was found after an employee tasted peanut butter in a bar labeled chocolate chip. The employee sampling the item did not have a peanut allergy and did not experience a reaction. Her observation led to the recall of Lot #19177. Subsequent investigation indicates the problem was caused by a temporary breakdown in the company's production and packaging processes.

Consumer Allergic Reaction Triggers Recall of  Meal Bars -  PROBAR LLC of Salt Lake City, UT has initiated a voluntary recall of select flavors and lots of Meal® bars, including Chocolate Coconut, Peanut Butter Chocolate Chip, Original Trail Mix, Wholeberry Blast and Superfood Slam due to the possible presence of undeclared milk and soy allergens. PROBAR learned of the issue after receiving a complaint of an allergic reaction in a consumer after eating a PROBAR: MEAL Peanut Butter Chocolate Chip bar. Our investigation determined that an ingredient potentially contained milk and soy. To date, PROBAR has received this one report of illness.

Someone Missed that Worcestershire Sauce Contains Fish (anchovies) - .Baumer Foods, Inc. of Metairie, LA is recalling 10 oz PICS Soy Sauce, because it may contain undeclared fish   The recall was initiated after it was discovered that product was labeled as Soy Sauce without the known fish allergen but the bottle actually contained Worcestershire sauce. Worcestershire Sauce has the known allergen fish. Subsequent investigation indicates the problem was caused by a temporary oversight during the packaging processes.

Sour Cream & Onion Potato Chips in Wrong Bag - Olde York Potato Chips of Brampton, Ontario is recalling Clancy's Wavy Potato Chips 10 oz (UPC 0 41498 16306 8) with the specific lot code BEST If Used By FEB 22 19 1A6 because they may contain undeclared milk.  The issue was discovered when two consumers reported nding sour cream& onion seasoning on Clancy's Wavy Potato Chips 10 oz BEST If Used By FEB 22 19 1A6. Olde York conducted an investigation which indicated that the problem was caused by an isolated breakdown in the company's cleaning process.

Residual Almond into Milk after Improper Line Clean Out Shamrock Farms of Phoenix, Arizona is issuing a voluntary recall of Shamrock Farms 2% Reduced Fat Vanilla Half Gallon Milk with Best Before Date 3/16/2019. The recall comes after a product retain of Shamrock Farms 2% Reduced Fat Vanilla Half Gallon Milk with Use By 03/16/19 Time Stamp 08:18-11:13 04-05 #1, tested positive for an undeclared tree nut (almond) allergen.The undeclared allergen is due to cross-contact with an almond-contained product in the production facility, and was discovered in retained samples during testing.

Many Adults Who Think They Have Food Allergies Are Not Allergic

In a study published in JAMA Network Open, only about 1/2 of the adults who claim to have a food allergy are actually allergic.  "Researchers discovered that only half of adults with convincing food allergy had a physician-confirmed diagnosis, and less than 25 percent reported a current epinephrine prescription."  The take home here is that if you think you have an allergy, have it medically checked.

They also found that about half of the adults developed one of thier food allergies as an adult.  It was most common for those to develop allergies to shellfish as an adult.  "The study data indicate that the most prevalent food allergens among U.S. adults are shellfish (affecting 7.2 million adults), milk (4.7 million), peanut (4.5 million), tree nut (3 million), fin fish (2.2 million), egg (2 million), wheat (2 million), soy (1.5 million), and sesame (.5 million)."

Improper Line Clean-out in Snack Process - Whole Foods Market is voluntarily recalling 365 Everyday Value White Corn Tortilla Chips because the product may contain undeclared milk that was not listed on the product label.  The issue was discovered after a customer notified Whole Foods Market that the tortilla chip bag also contained other snack mix products.

Improper Line Clean-Out in Dairy Process - Harris Teeter is notifying shoppers of a voluntarily recall of Harris Teeter Low Fat Frozen Yogurt Cookies & Cream due to undeclared peanut product.  The firm was notified of the problem via a consumer comment of finding peanut butter cups in the product. Subsequent investigation indicated that the problem was caused by a mix-up of the cartons.

Pre-bake Egg Spray Not Accounted for on Label - New Seasons Market LLC is recalling NSM 8-pack mini butter croissants and 8-pack mini chocolate croissants because they contain undeclared egg. The recall was initiated after it was discovered that products containing egg were distributed in packaging that did not reveal the presence of egg. Products were slightly sprayed with egg before baking. [Label design issue]

Buffalo Chicken Calzones Labeled as Ham and Cheese Calzones - A Mass. establishment is recalling approximately 1,881 pounds of ham and cheese calzones due to misbranding - The product is labeled as a ham and cheese calzone, but the package contains a buffalo chicken calzone. [Operations packaging error]

State Lab Detects Undeclared Peanuts in Cookies - A Brooklyn, NY firm is recalling its 17.6 oz (500g) package of “Melanie Mini Cookies with Caramel Flavor”, because they contain undeclared peanuts. The recall was initiated after routine sampling by New York State Department of Agriculture and Markets Food Inspectors and subsequent analysis by Food Laboratory personnel revealed that the peanut –containing product was distributed in packages that did not reveal the presence of peanuts.

Question of the Week - Coconut a Tree Nut Allergen?

Is coconut a tree allergen?    FDA classified coconut in the Big 8 Allergen groupings as a tree nut.  Technically, coconut is not a botanical nut, but is a one seeded drupe, or a one seeded fruit.  But since it can be argued that it is a nut of sorts, it can be added with the other tree nuts.  No harm, no foul.

Coconut allergies are pretty rare, but for the few of those who are allergic, it can be serious, including anaphylaxis.  There is much less likelihood of cross reactivity from the other tree nuts to coconut in terms of allergies, although there have been a few cases.

Will Sesame Be Added to the Big Eight for Required Allergen Labeling?

There is a push to get sesame added to those allergens that require labeling as part of the FALCPA -
Food Allergen Labeling and Consumer Protection Act of 2004.  While sesame label declaration is already required in Canada and Europe, it is not here.  It seems though, that many US companies may already be doing so.  Will it get to the point where there is enough pressure to push FDA to add this to the list....not sure, but it may be worth the effort to understand where you may be using sesame, especially when part of a natural flavor or spice ingredient.

According to FARE (Food Allergy Research and Education), a 2010 study indicated that about 0.1 percent of the population has a sesame allergy.  I have never run across anyone who stated having a sesame allergy.

WASHINGTON—Fourteen of 22 major food manufacturing companies declare the presence of sesame and do not obscure it as an unspecified “spice” or “natural flavoring,” according to a new report by the nonprofit Center for Science in the Public Interest.  But the remaining companies do not provide appropriate labeling, leaving consumers at risk for potentially life-threatening allergies.

Limited Production Run Mislabeled  - Ciolo Foods of Lafayette, CO has voluntarily recalled it’s 7-ounce containers of “Nut-Free Basil Pesto” because they contain undeclared tree nuts (Pine Nuts and Walnuts). The recall was initiated after discovery that some of this limited run of product was mislabeled. No other lots were affected by this issue. [Production labeling issue]

Contract Manufacturer Error - IDLife, LLC of Frisco, TX is voluntarily recalling its line of Protein Bars (Lot #s PR33471, PR31771, & PR31971), Snack Bars (Lot #s SN32071 & SN30771), and Kids Bars (Lot #s A3617-1 & 03047-1), because they may contain undeclared allergens. As part of its quality control review process, IDLife discovered that the lots of Protein Bars referenced above may contain undisclosed almonds, the lots of Snack Bars referenced above may contain undisclosed peanuts, and the lots of Kids Bars may contain undisclosed almonds and coconut oil. The recall was initiated after IDLife’s quality control team discovered a problem at the Company’s contract manufacturer for its bars. Subsequent investigation indicates the problem was caused by a temporary breakdown in the contract manufacturer’s quality control procedures.

Reaction to Improperly Listed Allergen - Kodiak Cakes of Park City, UT is recalling all lots and codes of Kodiak Cakes Blueberry Chia Energy Waffles 10.72 oz that were on shelf prior to March 5, 2018 because they contain undeclared milk. The improper labeling was discovered when a consumer notified Kodiak Cakes that a family member had a reaction to the product and that “milk” was not included in the allergen statement. While the specific ingredient “whey” is included in the ingredient declaration, the presence of milk is not identified in the ingredient list or declared in the allergen “contains” statement. Label Missing Allergens - Weis Markets today announced it has expanded its recall for its store-made Weis Quality Dried Beef Party Rye dip for failing to list egg and milk allergens on its label. The issue was discovered during a routine inspection. [Label design issue]

Ice Bars Recalled After Reported Complaint for Allergic Reaction - California Popsicle, Inc. dba Polly Ann Ice Cream of South San Francisco, CA is recalling ice bars, because it may contain undeclared milk.  The recall was initiated after notification by FDA of a consumer complaint in Canada.

Instant Coffee Mix Missing Milk on Label - Hong Lee Trading Inc., NY, is recalling its CHAO CAFÉ VIETNAMESE INSTANT COFFEE MIXED 3 IN 1, 384 GRAM, CONTAINER CODE JUNE 06 2018, because they contain undeclared milk allergens.  The recall was initiated after routine sampling by New York State Department of Agriculture and Markets Food Inspectors and subsequent analysis by Food Laboratory personnel revealed the presence of milk allergens in the packages [of product] which did not declare a milk ingredient on the label.

Veggie Cups labeled as Fruit Cups - Condies Foods of Kearns, UT is recalling 166 cases of veggies cups because they were labeled as fruit cups.  The veggie cups had dressing  which was not on the fruit cup label so there is a possibility that this may contain undeclared milk and egg allergens. After getting an initial complaint from a customer about the label not matching the description of the product, after seeing the pictures from the email it was decided to initiate a voluntary recall to ensure that our public would not get further exposure to an erroneous product.

Eggs Left Off Label - New Seasons Market has initiated a voluntary recall of its New Seasons Market Grab and Go pre-packaged Macaroni and Cheese because it may contain undeclared egg. An employee noticed the mislabeled packages during a routine stock rotation check. New Seasons Market Macaroni and Cheese normally contains eggs, but eggs were accidentally left off the ingredients list and the “contains” allergens statement on the label.

Milk Not Declared on Label - Daisy’s Bakery Inc. of Clifton, New Jersey is recalling 4 ounce packages of Gourmet Concha, because it may contain undeclared milk. The recall was initiated after it was discovered that the milk containing product was distributed with a label that did not reveal the presence of milk. Subsequent investigation indicates the problem was caused by a temporary breakdown in the company’s production and packaging processes.

Soy Found In Product - PFP Enterprises LLC, also doing business as Texas Meat Packers, a Fort Worth, Texas establishment, is recalling approximately 7,570 pounds of ground beef products due to misbranding and an undeclared allergen, soy, which is not declared on the product label. The problem was discovered when FSIS received a complaint from a school about the product’s packaging. FSIS laboratory testing confirmed that the product contained soy and added water.
