MA Dairy Recalls Soft Cheese Product After Consumer Infection by Listeria

Cricket Creek Farm of Williamstown, MA is recalling 165 units of Sophelise cheese and 149 pounds of Tobasi cheese because it has the potential to be contaminated with Listeria monocytogenes. One hospitalization due to Listeria monocytogenes has been reported to date. Following this customer notification of illness, products purchased by this individual were tested by Biotrax Testing Laboratory and the current batch of Sophelise was determined to be positive for Listeria monocytogenes. The three batches of Tobasi are being recalled due to their proximity during storage to the exposed product.

Cricket Creek Farm is a small, grass-based cow dairy located in Williamstown, MA.  They produce raw milk, grass-fed beef and whey-fed pork, and 7 farmstead cheeses.   Sophelise cheese, according to the company's website, "is a soft cheese in the washed rind family, with an identity all its own. A pungent rind for fans of Reblochon, and a texture for lovers of Brie. A Cricket Creek Farm original, that even the experts can’t define. Made from pasteurized milk."

Listeria is a definite challenge for small dairy operations that produce cheese along with doing a lot of other stuff (in this case...producing raw milk, beef, pork, conducting tours, hosting weddings).  One could guess is that if Listeria in one lot of cheese, then it likely be in more product.

CDC MMWR - Foodborne Illness Outbreaks at Retail Food Establishments

In CDC MMWR, a report titled Foodborne Illness Outbreaks at Retail Food Establishments — National Environmental Assessment Reporting System, 25 State and Local Health Departments, 2017–2019 provides insight into outbreaks associated with retail food establishments.
The top four issues and most probable contributing factors (from Table 2 below):
  • Norovirus (261 incidents) and the need to have a food health policy, and more importantly, to enforce that policy.  
  • Salmonella (103 incidents)- Preventing cross contamination and cooking to correct temperature.
  • Vibrio (39 incidents) - contaminated raw food eaten raw or undercooked
  • Clostridium perfringens (36 incidents) - improper cooling or holding
Items from the report:
  • During 2017–2019, a total of 800 foodborne illness outbreaks associated with 875 retail food establishments were reported to NEARS by 25 state and local health departments. 
  • Among outbreaks with a confirmed or suspected agent (555 of 800 [69.4%]), the most common pathogens were norovirus and Salmonella, accounting for 47.0% and 18.6% of outbreaks, respectively.
  • Of the 725 managers interviewed, most (91.7%) said their establishment had a policy requiring food workers to notify their manager when they were ill, and 66.0% also said these policies were written. 
  • Only 23.0% said their policy listed all five illness symptoms workers needed to notify managers about (i.e., vomiting, diarrhea, jaundice, sore throat with fever, and lesion with pus). 
CDC provided this interpretation - "Norovirus was the most commonly identified cause of outbreaks reported to NEARS, and contamination of food by ill or infectious food workers contributed to approximately 40% of outbreaks with identified contributing factors. These findings are consistent with findings from other national outbreak data sets and highlight the role of ill workers in foodborne illness outbreaks. Although a majority of managers reported their establishment had an ill worker policy, often these policies were missing components intended to reduce foodborne illness risk. Contamination of food by ill or infectious food workers is an important cause of outbreaks; therefore, the content and enforcement of existing policies might need to be re-examined and refined."
"Only 16.1% (117 of 725) of establishments had policies that included the four recommendations of the FDA Food Code that were assessed. These recommendations were to have a policy that required workers to tell a manager when they are ill, a policy that specified all five symptoms workers need to tell a manager about, a policy that restricted or excluded ill or infectious workers from working, and a policy that specified all five symptoms requiring restriction or exclusion. Fewer than half (316 of 725 [43.6%]) of managers said their establishments provided paid sick leave to any workers."

The top five contributing factors to foodborne illness outbreaks were all contamination related (Box 2).
  •  The most common contributing factor was other mode of contamination (excluding cross-contamination) by a worker who was suspected to have an infectious illness (104 [20.8%]). 
  • Other sources of contamination included contaminated raw food (88 [17.6%]), bare-hand contact with ready-to-eat (RTE) food by a food worker suspected to have an infectious illness (72 [14.4%]), cross-contamination of ingredients (68 [13.6%]), and other unspecified source of contamination (62 [12.4%]) (Table 2). 
  • Contributing factors associated with ill workers (i.e., bare-hand contact with RTE food, gloved-hand contact with RTE food, and other contamination by workers suspected of having an infectious illness) were identified in 205 (41.0%) outbreaks.
  •  The most common proliferation contributing factor was improper or slow cooling of hot food (53 [10.6%]), and the most common survival contributing factor was insufficient time or temperature during cooking or heat processing (33 [6.6%]).

Neb Sprouting Facility Issued Warning Letter After Salmonella Outbreak

FDA issued a Warning Letter to Rhodes Legacy Inc DBA Sun Sprouts, a sprouting operation located in Omaha, Nebraska.  The inspection comes after sprouts were linked by epidemiological and traceback evidence to an outbreak of human infections with Salmonella Typhimurium.

The FDA "inspection revealed serious violations of the Standards for the Growing, Harvesting, Packing, and Holding of Produce for Human Consumption regulation (Produce Safety Regulation or PSR), Title 21, Code of Federal Regulations, Part 112 (21 CFR Part 112). Based on [the] inspectional findings, [FDA] determined that [the] sprout products are adulterated."

Primary inspectional findings:
  • "Failed to meet the requirement to test spent sprout irrigation water from each production batch of sprouts for E. coli O157:H7 and Salmonella spp. or, if such testing is not practicable, test each production batch of sprouts at the in-process stage (i.e., while sprouts are still growing) for E. coli O157:H7 and Salmonella spp."
  • "Did not test the spent sprout irrigation water (or sprouts) from each production batch of sprouts for Salmonella spp. using either (1) the method of analysis described in “Testing Methodologies for E. coli O157:H7 and Salmonella species in Spent Sprout Irrigation Water (or Sprouts),” Version 1, October 2015, FDA or (2) a scientifically valid method that is at least equivalent to this method of analysis in accuracy, precision, and sensitivity, as required by 21 CFR 112.153(a)"
  • "Did not clean and sanitize food contact surfaces that you use to grow, harvest, pack, or hold sprouts before contact with sprouts or seeds or beans used to grow sprouts...investigators observed significant filth on the irrigation nozzles for your mister."

CDC MMWR - Salmonella Outbreak with Non-RTE Breaded Stuffed Chicken Products

Commercially produced non-RTE frozen breaded stuffed chicken products, such as chicken cordon bleu, have been a repeated source of Salmonella infection.  "During 1998–2022, 11 Salmonella outbreaks linked to these products were reported; 57% of samples per outbreak from patient homes and retail stores yielded Salmonella."

Although packing has cooking instructions, people continue to prepare them, or handle them as if they are fully cooked items.  The reason is that they appear to be cooked, which they are in order to set the coating, but not to the point where the chicken itself if cooked to eliminate Salmonella contamination.

What is already known about this topic?
Not ready-to-eat breaded, stuffed chicken products have repeatedly been a source of Salmonella outbreaks. On April 28, 2023, the U.S. Department of Agriculture proposed to declare Salmonella an adulterant in these products.

What is added by this report?
During 1998–2022, 11 Salmonella outbreaks linked to these products were reported; 57% of samples per outbreak from patient homes and retail stores yielded Salmonella. Outbreaks continue to occur, although a smaller percentage of patients reported cooking the product in a microwave after labeling changes.

What are the implications for public health practice?
Outbreaks have continued despite consumer-based interventions. Additional control measures for Salmonella contamination by manufacturers could reduce Salmonella-involved illnesses associated with these products.

Article on Salmonellosis in Infants Resulting in Increased Health Risks

An article in the journal Pediatrics titled "Epidemiology of Salmonellosis Among Infants in the United States: 1968–2015 " looks at nontyphoidal Salmonella infection in infants which results in high rates of hospitalization and death due to the increased risk of invasive infection.

The study did not provide information regarding the source of the contamination. 
 "These data do not provide information to assess sources of Salmonella or risk factors for invasive disease; demographic characteristics are described as risk indicators. Reported risk factors for infant salmonellosis include exposure to animals, exposure to a household member or attending day care with a child with recent diarrhea, international travel, riding in a shopping cart with raw meat or poultry, and other indoor and outdoor environmental exposures.15,–18 Use of infant formula and lack of breastfeeding are correlated risk markers.15,19,Salmonella has only rarely been identified in commercial formula.20,21 Breastfeeding might be protective because of immunity (eg, maternal antibodies from breastmilk) or to lack of exposure to bottles contaminated by household members."

Mislabeled Wing Sauce Results in Undeclared Soy Allergen

T.W. Garner Food Company is voluntarily recalling 50,688 bottles of 12 oz. Texas Pete® Buffalo Wing Sauce with best used by 120623T 065239 UPC 0 75500 10011 6 because some of the bottles may contain Texas Pete® Extra Mild Wing Sauce which contains soy.  The recall was initiated after a report was received from a direct customer that a bottle labeled as Texas Pete® Buffalo Wing Sauce was located instead of Texas Pete® Extra Mild Wing Sauce. The bottle of Texas Pete® Buffalo Wing Sauce was missing the allergen declaration of soy. Investigation indicates the problem was caused by applying the wrong label during a portion of the production run.

While the products look different, the labels are nearly identical.  This is where a properly implemented Allergen Preventive Control at the point of labeling is critical.

NY Boutique Ice Cream Company Recalls Product Due to Undeclared Walnuts

Van Leeuwen Ice Cream of Brooklyn, NY is voluntarily recalling 4,096 frozen 14 oz pints of its French Ice Cream product "Brown Sugar Chunk” because it contains an undeclared allergen, walnuts.  The recall was voluntarily initiated after a customer complaint led to the discovery that the ice cream in this lot contains walnuts but was distributed in packaging that did not declare the presence of walnuts. The cause of the product labeling error is being investigated.

This appears to be an issue of the product filled into prelabeled cups.

FL Company Recalls Frozen Popsicles Due to Undeclared Allergens

DIBE LLC. of MIAMI, FL, is recalling its 6 ounces packages of "TETAS MIREYA SABOR NUTELLA, TODDY, FERRERO, GALLETA MARIA & GALLETA OREO " food popsicles because they may contain undeclared allergens:  The recall was initiated after it was discovered by an Florida Department of Agriculture and Consumer Services supervisor at one retail store called Pastelitos Chips in Orlando, Fl. that the soy, wheat, and walnut-containing products were distributed in packaging that did not reveal the presence of soy, wheat, and/or walnuts. Subsequent investigation indicates the problem was caused by a temporary breakdown in the company's production and packaging processes.

From the pictures, it appears that are some multi-ingredient components that were not broken down to identify the allergens.

CDC Investigating Salmonella Outbreak Associated with Cookie Dough

FDA and CDC, in collaboration with state and local partners, are investigating an outbreak of Salmonella Enteritidis infections linked to Chocolate Chip Cookie and S’mores Bars dough sold at Papa Murphy’s franchises. To date, there have been 18 cases with 2 hospitalizations.

Papa Murphy's is a Washington based take-and-bake food company that operates over 1,300 outlets, primarily in the US. The company's primary focus is pizza, where you have the raw pizza prepared, and then you take it home to bake it. They also sell raw cookie dough, and provide cooking instructions.

This is just another reminder for the significant risk of Salmonella in raw cookie dough.

Beer Can Chicken Beer

Wow, here's a thing...beer designed specifically for cooking chicken on grill using the beer-can-cooking technique. Pretty sure I do not want to drink beer with rosemary and thyme in it (may think otherwise after giving it a sip), but would be willing to give it a try when cooking a bird on the grill. FDA Issues Small Entity Compliance Guide for Traceability Rule

FDA issued its Small Entity Compliance Guide for the Requirements for Additional Traceability Records for Certain Foods. "This guidance document is intended to help small entities, including farms and small businesses, comply with the requirements of the Food Traceability Rule as established in  21 CFR part 1, subpart S. The regulations are binding and have the full force and effect of law."
The compliance date is Jan 20, 2026.

The certain food items are those listed on the FTL (Food Traceability List).
  • Cheeses, other than hard cheeses, specifically:  
    • Cheese (made from pasteurized milk), fresh soft or soft unripened
    • Cheese (made from pasteurized milk), soft ripened or semi-soft
    • Cheese (made from unpasteurized milk), other than hard cheese[1]
  • Shell eggs Shell egg means the egg of the domesticated chicken.
  • Nut butters
  • Cucumbers (fresh) Includes all varieties of fresh cucumbers.
  • Herbs (fresh) Includes all types of fresh herbs. Examples include, but are not limited to, parsley, cilantro, and basil. Herbs listed in 21 CFR 112.2(a)(1), such as dill, are exempt from the requirements of the rule under 21 CFR 1.1305(e).
  • Leafy greens (fresh) Includes all types of fresh leafy greens. 
  • Leafy greens (fresh-cut) Includes all types of fresh-cut leafy greens, including single and mixed greens.
  • Melons (fresh) Includes all types of fresh melons. 
  • Peppers (fresh) Includes all varieties of fresh peppers.
  • Sprouts (fresh) Includes all varieties of fresh sprouts (irrespective of seed source), including single and mixed sprouts. 
  • Tomatoes (fresh) Includes all varieties of fresh tomatoes.
  • Tropical tree fruits (fresh) Includes all types of fresh tropical tree fruit. 
  • Fruits (fresh-cut) Includes all types of fresh-cut fruits.

  • Molluscan shellfish, bivalves (fresh and frozen)[5]
  • Ready-to-eat deli salads (refrigerated)
There is an entire list of full and partial exemptions and what is required for each.  Each operation will need to determine what actions are required based upon the specific applications.

But for those subject to the Rule, these are the requirements?

What Traceability Plan Must I Have for Foods on the FTL that I Manufacture, Process, Pack, or Hold? (§ 1.1315) If you are subject to the requirements of the Food Traceability Rule, you must establish and maintain a traceability plan containing the following information: 
  1. A description of the procedures you use to maintain the records you are required to keep under the Food Traceability Rule, including the format and location of these records; 
  2. A description of the procedures you use to identify foods on the FTL that you manufacture, process, pack, or hold; 
  3.  A description of how you assign traceability lot codes to foods on the FTL in accordance with § 1.1320, if applicable; 
  4.  A statement identifying a point of contact for questions regarding your traceability plan and records; and 
  5.  If you grow or raise a food on the FTL (other than eggs), a farm map showing the areas in which you grow or raise such foods. The farm map must show the location and name of each field or other growing area where you grow a food on the FTL, including geographic coordinates and any other information needed to identify the location of each field or growing area. For aquaculture farms, the farm map must show the location and name of each container (e.g., pond, pool, tank, cage) in which you raise seafood on the FTL, including geographic coordinates and any other information needed to identify the location of each container

FDA issued a Warning Letter to Gary’s Cheesecakes & Fine Desserts, a Cincinnati, Ohio processor of ready-to-eat (RTE) bakery products.  First, there was some significant indicators of rodent and insect activity including presence of rodent poop around ingredient storage and the finding of a dead rat in a trap.  It important to note that similar inspection items were found during a 2020 inspection.
The facility was also not registered with FDA.  Hard to know if the facility had a Food Safety Plan, but one would guess not.

Canadian Establishment Recalls Mortadella Deli Meat for Undeclared Tree Nuts - Pistachio

Sofina Foods Inc., a Markham, Ontario, Canada establishment, is recalling approximately 15,165 pounds of ready-to-eat mortadella deli meat products due to misbranding and undeclared allergen, the product may contain pistachio (tree nuts), a known allergen, which is not declared on the product label.
The problem was discovered when the establishment notified FSIS that a customer observed pistachio nut in ready-to-eat regular mortadella deli meat product during slicing.  There have been no confirmed reports of adverse reactions due to consumption of these products.

Pistachio is commonly added to mortadella.

Colostrum Product Recalled After Failing to State Contains Milk

Nature’s Energy Children’s Chewable Colostrum is being recalled after it was discovered that the Colostrum containing product was distributed in packaging that did not indicate the presence of milk proteins.  A quick search on the internet revealed that this is not the only product in this category that failed to post a 'Contains' statement for Milk.

Colostrum is milk.   From Healthline -  Bovine colostrum is made from the milky fluid a cow secretes after giving birth. It may help improve immunity, fight germs, and promote gut health. It appears safe for people, but more research is necessary.  Colostrum is a breast fluid produced by humans, cows, and other mammals before breast milk is released.  It’s very nutritious and contains high levels of antibodies, which are proteins that fight infections and bacteria.  Colostrum promotes growth and health in infants and newborn animals, but research shows that taking bovine colostrum supplements may promote immunity, help fight infections, and improve gut health throughout life."

FDA Updates Investigation of Illnesses Associated with Mushrooms in MT

FDA issued a report on illness that occurred in a Montana restaurant and may be associated with toxic mushrooms.  There have been a total of 50 cases with 3 hospitalizations and 2 deaths.  The last report was issued on May 3, 2023.
  • "As of May 15, 2023, the investigation has identified 50 ill people who ate at the restaurant between March 28 and April 17, 2023, of whom 44 people reported eating morel mushrooms. There have been three hospitalizations and two deaths associated with this incident. A sample of leftover mushrooms were collected from the restaurant and laboratory analysis determined that the sampled mushrooms were true morels."
  • "Currently, no pathogen, toxin, pesticide, or heavy metal has been identified; however, state and local partners have collected consumer samples from the restaurant and testing and analysis are ongoing. Although epidemiological evidence indicates that morel mushrooms consumed at the restaurant are likely the cause of illnesses, mushroom poisonings can be difficult to diagnose as the exact chemical nature of some toxins found in wild-type mushrooms are currently unknown."
  • "Although the mushrooms sampled from the restaurant were found to be true morels, there are varieties of “false morels” that may be mistaken for a true morel due to a similar appearance. “False morels” are toxic and should not be consumed, cooked or uncooked. Gyromitrin is a toxin found in some varieties of false morel mushrooms and it has been linked to several cases of mushroom poisoning and can be fatal even in relatively small amounts. Gyromitrin poisoning can cause symptoms such as headache, vomiting, diarrhea, dizziness, loss of coordination, and in severe cases, seizure, heart failure, liver and kidney damage and death. Gyromitrin toxin can be partially broken down by high temperature; however, even with cooking, toxins may remain and can lead to illness or toxicity."

Mitten Gourmet, LLC, a Freeland, Michigan establishment, is recalling approximately 1,137 pounds of ready-to-eat pork rind products that were produced without the benefit of federal inspection, the U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced today.  The problem was discovered during routine FSIS surveillance activities when the ready-to-eat pork rind products were observed for sale without the USDA mark of inspection. FSIS determined that the producer is not an FSIS-inspected facility.

According to the Mitten Gourmet website "Mitten Gourmet is a family owned small business established in 2018. Our family loves the feeling of having fresh homemade products in our everyday lives. This company produces a number of snacks including popcorn, pretzels and cotton candy, and if one had to guess, decided to add pork rinds, a USDA regulated product,  but failed to get USDA inspection.

We have received a report that a package of cookies was labeled as Oatmeal Raisin but may have contained Peanut Butter Cookies. As a result, peanuts and soy were not listed within the ingredient statement.

Pesto Packed into Hummus Dip Containers Recalled for Undeclared Milk and Walnuts

Bakkavor USA is issuing a voluntary recall of Trader Joe’s Genova Pesto (SKU# 15759) because the product may contain undeclared milk and walnuts.  The recall was initiated after it was discovered at a retail store that the Genova Pesto was mistakenly packaged into tubs marked "Hummus Dip”. These tubs do not contain an allergen declaration of milk or walnuts, which are both found in the Genova Pesto.

From the pictures, the top lid label stating pesto was correct, but the tubs pre-printed container label states hummus.  So someone put the wrong preprinted tubs into the filler.  An Allergen Preventive Control would include ensuring both the lid and container are in agreement with the product being packed.

MA Sprout Operation Expands Recall to All Product Due to Listeria

Chang Farm of Whatley, MA is expanding their May 5th recall to include ALL Mung Bean Sprouts and Soy Bean Sprouts within expiry because of the possible presence of Listeria monocytogenes (L. Monocytogenes)

An expansion of a recall due to Listeria is too often a common outcome when the Federal inspectors find that the company did not have adequate Listeria controls in place.  So the initial recall in this case was discovered through State lab testing.  Investigators will often launch an inspection of the facility.  If they find that there are systemic issues that would indicate broader contamination, the company will be asked to expand the recall to more product.  In this case, all product produced by the company is being recalled (although for sprouts, there may not be a whole lot of product in commerce due to the short shelf life).

Montana Dept of Health has reported an outbreak that has affected over 30 people with at least two deaths after eating at Dave's Sushi in Bozeman MT. "The manner and cause of death for these two individuals will remain pending until autopsy and toxicology results are available. The pattern of illness identified through case investigation, to date, indicates individuals became sick within 30 minutes to 4.5 hours after their meal. Preliminary investigative findings indicate that food containing morel mushrooms may be the exposure of concern. Currently, no pathogen/toxin has been identified, and both state and federal partners continue to test clinical and food samples."

The Gallatin City-County Health Department, the Department of Public Health and Human Services (DPHHS), other local health departments, and federal agencies continue to investigate the foodborne illness outbreak linked to eating food at Dave’s Sushi in Bozeman.

The investigational activities are ongoing, and DPHHS and the Gallatin City-County Health Department acknowledge that the investigation may not be able to identify a specific pathogen as the source of this outbreak. This outbreak appears to be isolated to people who ate at Dave’s Sushi between March 31 and April 17, 2023. The restaurant remains closed, and there does not appear to be any further risk to the public.

This guideline replaces and expands upon information previously found in other guidance documents addressing the safe production of RTE fermented meat and poultry products.

USDA Issues Public Health Alert for CA Establishment's Frozen Meatloaf Due to Undeclared Milk

USDA issued a Public Health Alert for frozen ready-to-cook meatloaf entrée products produced by A.J. SONS, INC. of Laguna Beach, CA for undeclared milk.  These items were shipped to organizations serving the senior population in Southern California and were further distributed through home-delivery meal service programs.

The problem was discovered by FSIS during a routine label verification task. FSIS inspectors observed that the meatloaf contained milk, but the establishment did not list milk as an ingredient on the case label. The individual trays delivered to consumers do not include an ingredient statement. Consumers should be aware that in addition to milk, this product also contains the allergens egg, soy, and wheat.

WASHINGTON, May 2, 2023 – The U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) is issuing a public health alert due to concerns that frozen ready-to-cook meatloaf entrée products may contain undeclared milk, a known allergen. These entrees are removed from their master carton and delivered to consumers in ready to prepare trays that do not bear an ingredient statement. While egg, soy, and wheat are declared in the ingredient list that appears on the carton, milk is not. FSIS is issuing this public health alert to ensure that consumers with allergies to egg, milk, soy, and wheat are aware that these products should not be consumed. A recall was not requested because the products are no longer available for distribution to consumers.

Lancaster Foods is voluntarily recalling a limited quantity of 3 brands of already-expired Robinson Fresh, Lancaster, and Giant brand Kale, Spinach and Collard Green products produced at the company’s Jessup, Maryland facility. This recall is due to a possible health risk from Listeria monocytogenes. The recall was initiated after notification that a random sample of a single bag of Chopped Kale Greens product with a “BEST IF USED BY May 1 2023” date collected by the New York Agriculture and Markets Food Safety Division tested positive for the Listeria pathogen.

MA Sprouting Facility Recalls Bean Sprout After NY State Lab Finds Listeria

Chang Farm, 301 River Road, Whatley, MA is issuing a voluntary recall of Mung Bean Sprouts; all 10lb bags (as some bags may not have sell-by dates), as well as 12 oz retail bags, both packaged on April 23rd, 2023 (distributed on April 24th, 2023), produced by Chang Farm, with the specific sell-by date of May 7th, 2023 because of the possible presence of Listeria monocytogenes.  Sample analysis by New York State Department of Agriculture and Markets’ (NYSDAM) Division of Food Safety and Inspection confirmed Listeria Monocytogenes.

NH Greenhouse Facility Recalls Salad Greens After State Testing Finds E. Coli (STEC)


lÄ“f Farms of Loudon, N.H. is voluntarily recalling a single lot of the lÄ“f Farms “Spice” Packaged Salad Greens ("best by" date 5/5/23, lot number SP10723- 1RGH1, UPC 8 50439 00709 1) produced in its Loudon, New Hampshire greenhouse because they have the potential to be contaminated with Escherichia coli 0157:H7 (E. coli) bacteria.  No illnesses have been reported to date. The recall was initiated when the New Hampshire Department of Agriculture received a positive test result for E. coli 0157:H7 in a single package of lÄ“f Farms “Spice” Packaged Salad Greens (4 oz) as part of routine testing.

lÄ“f Farms, now a part of BrightFarms, is an indoor growing facility that services the New England states.  This is just another case related to the concerns of controlled environment growing facilities.  Last month, we discussed this as part of recall from a MI facility.  And there was also a recall from a GA facility.

Potato Chips Recalled for Undeclared Milk After Complaint Issued

Frito-Lay today issued a voluntary recall of a limited number – 146 bags – of 13 oz. and 15 5/8 oz. of Lay’s Classic Potato Chips that may contain undeclared milk ingredients from sour cream and onion potato chips. The recall is the result of an investigation following a consumer complaint.

Frito Lay has had a number of allergen related issues over the past several years.  In 2020, FDA issued a Warning Letter to the company after two allergen recalls at separate facilities.

Imported Tahini Recalled After State Lab Testing Finds Salmonella

Rushdi Food Industries, an Israeli based manufacturer, is voluntarily recalling their Mighty Sesame 10.9 Oz Organic Tahini (Squeezable) with the specific expiration date of 9/25/23 due t0 potential Salmonella contamination.  This recall was initiated when the company received a notification by the FDA and the Ohio Department of Health of the potential presence of Salmonella in this specific lot. The company has received no reports of illness or injury to date.

Schnuck Markets, Inc. of St Louis, MO has issued an allergy alert due to a mislabel on select containers of Culinaria Nut Mixes. The products may have mislabeled packaging, and the Culinaria Cashew & Macadamia mix may contain almonds, which is an allergen for some people. Mezcal Drinking Cups Recalled for Risk of Leaching Lead

Del Maguey Co., New York, NY is conducting a voluntary recall of certain ceramicware cups called copitas – small artisan cups traditionally used for drinking mezcal – because they may exceed FDA guidance levels for leachable lead.

The copitas were distributed free-of-charge to consumers at retail locations, events and tastings across the United States. Copitas were also included in value-added packs (VAPs) sold by retail stores since October 2022; the VAPs included a 750ml bottle of Del Maguey Vida de Muertos mezcal and 4 copitas. This recall covers all copitas distributed by Del Maguey to date.

The cup is made of red clay, with applied enamel on the surface that holds liquid inside. It holds a maximum of 1 oz, and measures 2.5 inches wide and 1 inch in height. The copitas can be identified by the embossed brand name “Del Maguey Single Village Mezcal” which encircles the word “Mexico” located on the inside of the cup. Images of the copitas and the VAPs sold at retail are pictured below.

"To date, no complaints of illness or injury related to usage of the copitas have been reported."  For one, I'm not sure the average consumer would recognize they are suffering the effects of lead poisoning with identifying the cups as the source.  Secondly, in order to get sufficient amount of lead ingested, one would probably have to consume an awful lot of mezcal, to the point where the alcohol consumed would be a bigger issue.  It is not like they are storing the booze in the cup.  Certainly not the same risk posed to ancient Romans who stored wine in leaden vessels.  But you never know.

FDA Issues Warning Letter to MI Processor of RTE Seasoned Pretzels

FDA issued a Warning Letter to Pop Daddy Popcorn Whitmore Lake, MI a processor of ready-to-eat (RTE) seasoned hard pretzels.  The Warning Letter included the following items:

Did not identify environmental pathogens as a food safety hazard in processing of RTE product with exposure.
  • "Did not consider contamination with environmental pathogens as a potential food safety hazard at the Mixing or Packaging/Sealing step to evaluate whether it requires a preventive control."
Examples of poor practices when handling RTE food 
"an employee was observed to touch an electrical control panel (which is not cleaned between production runs within a production day), dump a tumbler filled with RTE seasoned pretzels into a plastic bucket, scoop a handful of these seasoned pretzels from the bucket with their gloved hand, and place them back into the tumbler. The same employee then proceeded to open a box of pretzels including the interior bag and scoop those pretzels with a gloved hand into a plastic pitcher before placing those pretzels into the tumbler."
"During production of Pop Daddy Dill Pickle pretzels (Lot # 22822.1), plastic buckets containing RTE seasoned pretzels were sitting atop flattened cardboard on the floor. A bucket was observed slightly overhanging the cardboard and partially exposed to the floor. An employee’s hands were observed to touch the bottom of the buckets while emptying them into a packaging hopper, in the process also touching the inside of the buckets. The employee then placed the buckets under the mixing tumbler to fill with the next batch of RTE seasoned pretzels, without the buckets being washed or sanitized."
Did not verify the effectiveness of this preventive control by performing environmental monitoring 
  • "We note that your SOP titled “Environmental Monitoring,” dated October 24, 2018, states that you must (b)(4) take sample swabs at various points of the production process. However, during the inspection your management told FDA investigators that you do not recognize environmental swabbing as a verification of your sanitation controls. In addition, your environmental monitoring SOP did not identify the number of sites to be tested during routine environmental monitoring, the timing for collecting samples, or the test(s) conducted including the analytical method(s) used, as required by 21 CFR 117.165(b)(3)(iii-v)."
  • "Did not always follow your procedure. A review of your environmental monitoring results from 2020, 2021, and 2022 (in which you collected (b)(4) swabs respectively on (b)(4) as part of your routine sampling program) found that you frequently obtained results that exceeded your TPC limit of (b)(4) cfu/swab. For example, your 2021 environmental monitoring obtained results of (b)(4) cfu on (b)(4), (b)(4) cfu on (b)(4), and (b)(4) cfu on (b)(4) for the (b)(4) faucet handle. Also, your 2022 environmental monitoring obtained results of (b)(4) cfu on (b)(4) and (b)(4) cfu on (b)(4) for the warehouse worktable. In both cases, upon obtaining unacceptable TPC results, you took follow-up samples, which still indicated unacceptable TPC levels. There is no indication that you took any further action to bring the TPC level down to an acceptable level."
Supplier Preventive Controls for ingredients used in RTE applications
  • The "pretzel hazard analysis in your food safety plan, dated March 21, 2022, did not consider pathogens such as Salmonella in your RTE seasoning ingredients to determine whether they require a preventive control. Your process does not apply a lethal treatment to any of your incoming raw materials and ingredients used in production of your RTE pretzels. Some of these seasoning ingredients (e.g., garlic parmesan, dill, and cinnamon) have been associated with pathogens such as Salmonella. 
  •  During the inspection, the most recent survey and audit certificate from (b)(4), your supplier for garlic parmesan seasoning, was reviewed. However, the certificate was issued on May 11, 2021, so it was already three months past the annual audit timeframe required by your supply-chain procedure when we reviewed the certificate. Salmonella in RTE pretzels is a hazard that can cause serious adverse health consequences or death and thus an annual onsite audit is the appropriate supplier verification activity unless there is a written determination that other verification activities and/or less frequent onsite auditing of the supplier provide adequate assurance that the hazard is controlled (see 21 CFR 117.430(b)). The audit must be conducted before using the raw material or other ingredient from the supplier and at least (b)(4) thereafter (see 21 CFR 117.430(b)(1)(ii)).

FDA Releases Investigation Report on 2022 Salmonella Outbreak Associated with Cantaloupe

FDA released a report on a 2022 Salmonella outbreak that was linked to cantaloupe.  A recall or public health advisory had not been issued at the time because the investigation took longer than the cantaloupe was available for sale.

The investigation did not find a definitive source for the Salmonella strain found in the outbreak, although a common  packinghouse was identified.  The report does give some broad recommendations that packing houses, as well as farms, should be following.   Key among these, from my perspective, developing written procedures (SOPs) for the operation based upon reducing risk and then following these procedures with documentation.  It seems that this was the biggest knock against the firm in this investigation.

In August 2022, the U.S. Food and Drug Administration (FDA), Centers for Disease Control and Prevention (CDC), and state partners conducted an outbreak investigation into a multistate outbreak of  Salmonella Typhimurium linked to cantaloupe.

• States with Cases: GA (1), IL (5), IN (17), IA (38), KY (3), MI (3), MN (4), MO (2), OH (3), SC (1), WI (10)

The outbreak response investigation found:
1) In August 2022, CDC notified FDA about a multistate cluster of Salmonella Typhimurium illnesses 
with a potential signal for melon exposures. The cases were geographically distributed in the U.S. upper Midwest.
2) The isolates in this cluster of illnesses were within 7 alleles / 11 single-nucleotide polymorphisms 
(SNPs) of two FDA soil swab samples collected from a 2020 outbreak investigation in Indiana. As a part of the 2022 investigation, FDA and state partners collected multiple samples, but none of the resulting isolates were a definitive match to the 2022 outbreak strain.
3) FDA’s 2022 traceback investigation identified 11 points of service, of which 8 traced back to a  common packinghouse. Although a common packinghouse was identified, there was no convergence to a single shipment of products, and therefore three farms that supplied the common packinghouse were identified as potential sources of cantaloupe. 

All Purpose Flour Recalled After Sample Testing Finds Salmonella

General Mills today announced a voluntary national recall of two-, five- and 10-pound bags of its Gold Medal Unbleached and Bleached All Purpose Flour with a “better if used by” date of March 27, 2024, and March 28, 2024 due to the potential presence of Salmonella.  The recall is being issued for the potential presence of Salmonella Infantis,which was discovered during sampling of the five-pound bag product.

Public Health Alert Issued for WA Establishment's RTE Soup Produced That is Prematurely Spoiling

USDA-FSIS is issuing a public health alert due to concerns that ready-to-eat meat soup products from Ivars Company of  Mukilteo, WA, may have been prepared, packed, or held under insanitary conditions, which may result in the product spoiling prematurely.  The problem was discovered when the establishment notified FSIS that they had received multiple consumer complaints regarding bloated soup packages. Upon further review, the establishment found that some product spoiled prematurely. The establishment’s lab testing of the prematurely spoiled products found high levels of spoilage bacteria in the products.

GH Foods CA,  GHSW, Houston, TX and GHGA, Conley, GA  are recalling 8.55 oz packages of Turkey and Havarti Sandwiches due to undeclared sesame in bread.  The recall was initiated after it was discovered by a company internal review/audit that sesame in the bread was not declared as an allergen. Sesame was always an ingredient and should have been declared as an allergen starting January 1, 2023 as it was added to the list of the major food allergens.
