PA Firm Recalls Red Velvet Cake with Cream Frosting Due to Undeclared Milk

Electric City Sweets of Scranton, PA is recalling 1,644 Red Velvet Milk Chocolate Bars, due to undeclared milk in the ingredient statement and allergen statement.  The recall was initiated after a consumer reported the issue to the retailer where they had purchased the affected item. The milk-containing product was distributed in packaging identified with the allergen on the front panel display however it did not reveal the presence of milk in the ingredient list as required.

They forgot to include the cream frosting in the ingredient statement.



Scranton PA is nicknamed Electric City in that it was the first city to have electric street cars (1886) and one of the first to have electric street lights (1880).  Well before places like Johnstown, PA.

NY Firm Recalls Imported Tahini After State Lab Testing Finds Salmonella

Roland Foods, LLC (“Roland Foods”) of New York, New York is recalling a specific production code of Roland® Tahini (100% Ground Sesame Seeds) 16 oz. because it has the potential to be contaminated with Salmonella.  The recall was as the result of a routine sampling program by the Michigan Department of Agriculture and Rural Development, which revealed that the product tested positive for Salmonella. The company has ceased distribution of the product and has initiated an investigation in partnership with the manufacturer as to the root cause of the problem

Imported Cake Products Recalled for Undeclared Egg

LQNN Inc., of Garden Grove, California, is voluntarily recalling Banh Ba Xa and varieties of Banh Pia because they may contain undeclared egg.  The recall was initiated after it was discovered that the affected products may have been mistakenly had an egg wash applied. Subsequent investigation indicates the problem may have been caused by a mistake in the manufacturer’s production and packaging process.

According to Wikipedia, Banh Ba Xa is a "sweetheart cake or wife cake or marriage pie is a traditional Chinese cake with a thin crust of flaky pastry, made with a filling of winter melon, almond paste, and sesame, and spiced with five spice powder.[1] "Wife cake" is the translation of 老婆饼 from Chinese, and although the meaning is "wife", the literal translation is "old lady cake", paralleling the colloquial usage of "old lady" for "wife" in English. In Hong Kong, it is known as a specialty of the Yuen Long District.[2]"

Imported Dietary Supplements Recalled for Containing Yellow Oleander, a Poisonous Plant

 San Luis, AZ, G.A. Mart dba H&Natural, is voluntarily recalling 2 lots of H&NATURAL TejoRoot, 10g pills and 2 lots of H&NATURAL Brazil Seed, .167g Seeds to the consumer level. The products have been found via random FDA testing to contain yellow oleander, a poisonous plant native to Mexico and Central America.

Another recall, Backstage Center, issued a recall of approximately 280 Bottles of Alipotec Raiz de Tejocote, dietary supplements, that are labeled with the "Alipotec King" sticker. This recall is being initiated because FDA analysis found that the product contains toxic yellow oleander.

Risk Statement: Ingestion of yellow oleander can cause neurologic, gastrointestinal and cardiovascular adverse health effects that may be severe, or even fatal. Symptoms may include nausea, vomiting, dizziness, diarrhea, abdominal pain, cardiac changes, dysrhythmia and more.

The company, H&Natural, has received one report of gastrointestinal illness, including painful symptoms in conjunction with internal bleeding in connection with H&NATURAL TejoRoot and has not received any reports of adverse events in connection with H&NATURAL Brazil Seed.

FSIS Issues Health Alert for Prepared Meals Sold Online Due to Undeclared Egg Allergens

USDA-FSIS is issuing a public health alert for Nurture Life’s Chicken Parm with Super Veggie Spaghetti meal products due to misbranding and an undeclared allergen. The product’s spaghetti component contains egg white, a known allergen, which is not declared on the product label. FSIS is issuing this public health alert rather than a recall because the the product is no longer available for purchase.  The problem was discovered when FSIS was notified that the firm discovered that egg was not declared on the label during an internal audit.

The chicken meal packaging does not have a USDA mark of inspection. These items were sold online and shipped directly to consumers nationwide.  Nurture Life is a meal delivery service focused on providing prepared as ready-to-heat meals for children aged 10 months and older.  The company is Chicago based, but information on where the product is processed.

From a quick search, there seems that this company is given a pass because how the company positions itself as healthy.  However, and perhaps this is me, but what about the risk of shipping prepared meals for children through the mail where temperature control is not guaranteed?

FDA Warning Letters Issued to Food Importer for FSVP - Jan/Feb 2024 Edition

FDA issued Warning Letters to several food importers.  While three of the five were the same old thing, no FSVP for importer food, the other two had FSVP programs (for some items) but these programs were improperly designed and/or implemented.

FDA Issues Warning Letter to Iowa Egg Facility

In June of 2023, the Iowa Department of Agriculture, under contract with the Food and Drug Administration (FDA), inspected Iowa Egg Company Inc.'s Osage, IA shell egg farm and egg processing facility, where eggs are washed, graded, and packed.

FDA cited a number of issues where the company was not meeting the requirements.  
  • "Did not have and implement a written 'compliant' Salmonella Enteritidis (SE) Prevention Plan that includes, at minimum, the SE prevention measures required by 21 CFR118.4.   Had a plan, but was not viewed as compliant."
  • "Did not have written measures to ensure that there is no introduction or transfer of SE into or among poultry houses, as required by 21 CFR 118.4(b). Inspectors observed gaps for potential entry of pests and other animals to the poultry houses (including large gaps in the (b)(4) house), perimeter exhaust fans missing their protective cages, and other fans with protective cages that were not securely fastened."
  • "Did not adequately monitor pest activity - the bait consumption was not routinely monitored. Inspectors observed evidence of rodent activity, including droppings and chewed insulation in the (b)(4) house and did not routinely monitor fly activity, did not identify a threshold for acceptable and unacceptable fly activity, and did not identify corrective actions to take if unacceptable activity was observed. Further, flies were observed in the (b)(4) house."
  • "SE Prevention Plan did not include cleaning and disinfection procedures for poultry houses, in the event that you have an environment test or egg test that was positive for SE at any point during the life of a flock, as required by 21 CFR 118.4(d)."
  • "Did not hold or transport eggs at or below 45°F ambient temperature beginning36 hours after the time of lay, as required by 21 CFR 118.4(e). Your SE Prevention Plan stated “eggs should be stored in a cooler that is (b)(4)”; however, your cooler temperatures routinely exceeded 45°F. For example, from May 4, 2023, through June 4, 2023, the documented cooler temperatures ranged from 51°F to 68°Fconsecutively for 31 days."
  • "Did not conduct environmental testing for SE in your poultry houses when laying hens were 40 to 45 weeks of age, as required by 21 CFR 118.5(a). Specifically, the (b)(4) house and the (b)(4) house were tested when the flocks were approximately 48 weeks of age."
  • "Did not maintain records regarding your SE Prevention Plan in accordance with the requirements set forth by 21 CFR 118.10."
We take egg safety for granted when we cook those sunny-side up or over easy eggs.  However, if Salmonella is not controlled, these low cook methods may not be sufficient for eliminating a high level of Salmonella.

Frying Oil - Quality and Safety Considerations

An article in Food Technology magazine, Ensuring Quality and Safety in Fried Foods, provides basic principles for maintaining frying oil quality and ensuring safety. Many types of foods are fried in oil and these frying operations can occur in all sectors of the food supply chain - large food facilities. restaurant and food service establishments, non-profit fund raising operations, and consumer's home fryers. Frying oils are probably not given much thought until we eat something where that oil has become rancid, giving the food a nasty taste. Other issues for food safety include under-processed/undercooked product and product subject to allergen cross contact.

Pathogenic E. coli Outbreak with Ten Illnesses Linked to Raw Milk Cheddar Cheese

CDC and FDA are investigating an E.coli outbreak linked to raw cheddar cheese.  "As of February 16, 2024, a total of 10 people infected with the outbreak strain of E. coli have been reported from four states [CA - 4, UT - 2, CO - 3, and TX - 1]. Illnesses started on dates ranging from October 18, 2023, to January 29, 2024 (see timeline). Of 9 people with information available, 4 have been hospitalized and 1 developed hemolytic uremic syndrome, a serious condition that can cause kidney failure. No deaths have been reported.
  •  Of the 8 people interviewed, 6 (75%) reported eating RAW FARM brand raw cheddar cheese.
  • WGS showed that bacteria from sick people’s samples are closely related genetically. This suggests that people in this outbreak got sick from the same food.
  • No product samples consumed by consumers or products available for sale have tested positive for E.Coli 0157:H7.
  • Raw Farm, of Fresno CA is voluntarily recalling selected date codes of Raw Cheddar Cheese.
Because raw milk cheese is not pasteurized, the heat step is not present that would eliminate pathogens such as E. coli STEC.  Rather, aging along the presence of lactic acid bacteria (LAB) are counted on.

Purchasing Changes Ingredient But Misses Need to Update Label for Sesame

Capitol Distributing of Caldwell, Idaho is recalling 3,934 sandwiches because they may contain undeclared sesame.  Prepared turkey and cheese sandwiches included sesame that was not declared on the product label. Potential cross contact occurred when chicken salad on a croissant and egg salad sandwiches were prepared on the same surface as the turkey sandwiches.   A new bread source for sandwiches included sesame and the allergen was incorrectly left off of updated sandwich labels. The labels have been updated and any future possibility of cross contact has been eliminated.

The products were distributed in Arizona, California, Idaho, Nevada, Oregon, Utah and Washington. 

So what should have happened in the purchasing process to prevent this type of issue? Have an approval process for ingredients prior to purchase to ensure food safety parameters including allergens.  Linked to that, have ingredient specifications that identify risks needing controls including allergens..   Also, training those tasked with purchasing products on  food safety related issues including allergens in the ingredients being purchases AS WELL AS allergens handled by the supplier that may impact the ingredient purchased.

FL Establishment Recalls RTE Processed Meat Products After State Testing Finds Listeria

Don Novo & Son, a Miami, Fla. establishment, is recalling approximately 9,330 pounds of ready-to-eat (RTE) meat products that may be adulterated with Listeria monocytogenes.  The products subject to recall bear establishment number “EST. 34257” inside the USDA mark of inspection. These items were shipped to retail locations in Florida.  The problem was discovered when FSIS was notified that a sample collected by a state public health partner tested positive for the presence of L. monocytogenes.  There have been no confirmed reports of adverse reactions due to consumption of these products.

FDA Issued Warning Letter to Indiana Bakery for Sesame Control Issue

FDA issued a Warning Letter to an Indiana bakery that did not have proper label controls in place for sesame.  The inspection was triggered by a reported illness.
  • The firm recalled “Our Family” brand White Hot Dog Enriched Buns on March 21, 2023 after it was discovered that the product contained sesame, but the printed packaging did not declare sesame. The firm became aware of the undeclared sesame after being notified by a customer of an allergic reaction to sesame after a child consumed the buns.
  • The owner indicated that the firm reformulated “Our Family” brand White Hot Dog Enriched Buns in January 2023 by adding sesame to the formulation. On February 9, 2023, the facility received printed plastic packaging for the buns which did not declare sesame in the ingredients statement. Between February 9, 2023 and March 20, 2023, the facility manufactured the “Our Family” brand White Hot Dog Enriched Buns using the incorrect label, which resulted in undeclared sesame in the product.
  • On March 28, 2023, the company provided documents which indicated that they determined the root cause to be a “lack of label control,” as the receiver accepted incorrect packaging into the plant and the bagger operator used incorrect packaging that did not contain the correct allergen labeling. Owner stated that the action plan includes retraining “bag operators, break people, and supervisors” to check for correct allergen labeling “before being used at point of use”; updating policy to include the “QA manager or designated back-up visually verifying and documenting every receipt of bags before they can be received in (b)(4) and put in the warehouse”; creating a policy that future allergen labeling changes will require a new bag number, “making it impossible to receive old bag into plant”; and creating policy that will require new packaging proofs to be signed off by your company before new packaging can be printed. 
  • FDA stated they will verify implementation of any corrective actions during FDA’s next inspection of the facility.

It is a huge Warning Letter, so in quick summary:

  • Did not have proper controls in place for a cooked RTE product (w/pH > 4.6 and Aw close to 0.99) that could potentially support the growth of sporeforming pathogens such as B. cereus and C.botulinum.  Specifically time/temperature controls.

Oregon Case of Bubonic Plague (aka Black Death) Linked to Pet Cat

A case of bubonic plague in Oregon has been linked to the pet cat, which was suffering the illness.  This disease is caused by the bacterium Yersinia pestis and is he same disease which ravaged Europe during the middle ages.  Today, the disease is treatable but can become deadly if medical treatment is not received.

This cat was not responsible.

Coppa Meat from NJ Establishment, Source for Salmonella Outbreak, May Be Under-processed

Fratelli Beretta USA, Inc., a Mount Olive, N.J. establishment, is recalling an undetermined amount of ready-to-eat (RTE) meat charcuterie products containing Coppa that may be under processed, which may have resulted in possible contamination with foodborne pathogens. FSIS and CDC continue to investigate a multistate outbreak of Salmonella. that was linked to this product. FSIS collected unopened RTE Coppa product as part of the investigation, which tested positive for Salmonella, but that product was not released into commerce. After further investigation, FSIS determined that the product subject to the recall may be under processed. Further testing is ongoing to determine if the product sample that tested positive for Salmonella is related to the outbreak.

The company was linked to the Salmonella outbreak in early January and CDC released an update in mid-January at the case count continued to climb.

Coppa (also known as capicola, capocollo, cappacuolo or gabagool*) "is a traditional Italian cold cut made from a large cut of pork meat that starts at the solid muscle between the head (capo) and includes the fourth or fifth rib of the pork shoulder (collo), or neck and shoulder region.  A traditional Italian and Corsican pork cold cut, it is a whole-muscle salume, dry cured, and typically sliced very thinly.
(*gabagool is an Italian-American slang term popularized on the TV series, The Sopranos).

Capocollo is a dry-cured meat that requires a curing process to achieve its distinct flavor and texture. The curing process involves rubbing the meat with a mixture of salt, spices, and curing agents such as sodium nitrate or sodium nitrite. The cured meat is then hung to dry for several weeks to several months, depending on the desired level of dryness.  It does not have a heat kill step, but rather relies on curing agents (sodium nitrate / sodium nitrite), and a lengthy drying step.

  • The curing process is critical in producing a safe and flavorful capocollo. The salt and curing agents help prevent the growth of harmful bacteria, while the spices and seasonings add flavor to the meat. It is important to use the correct amount of salt and curing agents to ensure that the meat is properly preserved.
  • One common curing agent used in capocollo is Cure #2, also known as Prague Powder #2. This curing agent contains a mixture of sodium nitrate and sodium nitrite, which helps prevent the growth of bacteria and adds a distinct pink color to the meat. It is important to use the correct amount of Cure #2, as too much can be harmful to human health. Keep in mind that Piero does it naturally so if you wish to not use it follow the video.
  • During the curing process, the meat is rubbed with the salt and spice mixture, making sure to cover all areas of the meat. The meat is then placed in a curing chamber or hung in a cool, dry place to dry. The temperature and humidity levels must be carefully monitored to ensure that the meat dries properly.
  • After several weeks to several months, the capocollo should be ready to eat. The meat should be firm and have a slightly salty and savory flavor. It is important to slice the capocollo thinly to fully appreciate its flavor and texture.
  • Overall, the curing process is an essential step in making capocollo. It requires careful attention to detail and the use of proper curing agents to ensure that the meat is safe to eat and has a delicious flavor.

Richelieu Foods Inc. Wheeling Illinois has voluntarily recalled the 365 Whole Foods Market Vegan Ultimate Veggie Thin Crust Pizza, LOT CODE 06152024 with a best by date of 6/15/2024 because it may contain trace amounts of an undeclared Milk allergen.  This recall involves no more than 144 individual pizzas that inadvertently entered the supply chain. Multiple Recalls Issued After Using Recalled Cheese with Potential Listeria Contamination

With the expanded recall of Rizo-Lopez cheese products due to potential Listeria monocytogenes contamination, there have been 15 additional recalls issued from FDA regulated companies and one USDA regulated company that used these cheese products as components in their own food products (salads, taco kits, etc).  (recalls listed below)

The cheese product from this company, Rizo Lopez Foods' has been linked to an multi-year Listeria outbreak.  This product was not only sold in retail channels, but was used by multiple manufactures as part of products that are considered RTE - ready to eat.  

From a downstream processor's perspective, this is not only an issue from direct use of a contaminated product, but also the fact that having this cheese in the operation serves as a source of cross contamination in the operation.

As part of these downstream processors Food Safety Plan, they would be required to have a Supply Chain Preventive Control in place for this supplier.  There would be a requirement for those companies to ensure that the supplier, Rizo Lopez Foods, had a robust environmental monitoring program and potentially, would have also been testing product as part of their verification procedures.  This is a lot of extra eyes that could have potentially caught this.

Granted, low level contamination issues can be difficult to catch through product testing.  The biggest verification control is that producers environmental monitoring program.  This should give companies pause to consider how robust a supplier's environmental monitoring program is with regard to Listeria for a high risk product application like soft cheese being used in RTE applications.

Public Health Alert Issued After Consumers Find Rocks in Rice Pilaf Products

USDA-FSIS is issuing a public health alert due to concerns of a frozen ready-to-eat (RTE) chicken pilaf product that may be contaminated with foreign material, specifically rocks.  The problem was discovered when the establishment notified FSIS that it received multiple consumer complaints of rocks in the chicken pilaf. One consumer reported a dental injury from consuming the product.  The product was distributed to Trader Joe’s grocery stores nationwide.

FDA and CDC Provide Update on Lead and Cadmium in Imported Cinnamon Apple Sauce

FDA and CDC provided an update on lead contamination issue in cinnamon apple sauce imported from Ecuador.  As you know, they have identified the cinnamon as the source of the lead (and then later cadmium was identified as well), and the cinnamon was sourced from Sri Lanka.  Beyond that, there is no information on how the contamination got into the cinnamon.  

At this point, CDC states that there are 413 reported cases with 100 cases confirmed.

This shows how it is so important it is to work with your foreign supplier when they are controlling their suppliers.   As lawsuits arise from this, to what degree will those foreign suppliers shoulder the financial burden.

CA Firm Recalls Cheese Products After WGS Reveals Link to Ongoing Listeria Outbreak

The FDA and CDC are investigating illnesses in a multi-year, multistate outbreak of Listeria monocytogenes infections linked to queso fresco and cotija cheeses manufactured by Rizo Lopez Foods, Inc., of Modesto, California.    According to the notice, cases may date back to 2014. CDC investigated this outbreak in 2017 and 2021. Epidemiologic evidence in previous investigations identified queso fresco and other similar cheeses as a potential source of the outbreak, but there was not enough information to identify a specific brand.  Thus far there have bee 26 total illnesses with 23 hospitalizations and 2 deaths.

Interestingly, Hawaii State Department of Health tested and found Listeria in a sample of product, and a recall was issued on January 11, 2024.  Using whole genome sequencing, they were able to link these additional cases and show that this firm's product was responsible for many cases over many years.  

"A sample of Rizo Bros Aged Cotija tested positive for Listeria monocytogenes during sampling conducted by the Hawaii State Department of Health’s Food and Drug Branch in January 2024.In response to that finding, Rizo Lopez Foods, Inc. voluntarily recalled one batch of Rizo Bros Aged Cotija Mexican Grating Cheese (8oz) on January 11, 2024. CDC and FDA reopened the investigation in January 2024 after new illnesses were reported in December 2023 and whole genome sequencing (WGS) analysis of the cotija cheese sample showed that it is the same strain of Listeria that is causing illnesses in this outbreak."

Canadian Firm Recalls Humus Product Shipped to US Due to Undeclared Sesame

Summer Fresh Salads Inc. of Woodbridge, Ontario, Canada is recalling its Wegmans Harissa Hummus Topped With Harissa because they may contain undeclared sesame.  The recall was initiated when it was determined the sesame-containing product was distributed in packaging that did not reveal the presence of sesame. Subsequent investigation indicates the problem was caused by a labelling error.

Super Bowl and Chicken Wings

According to the National Chicken Council, Americans will consume 1.5 billion chicken wings during the day of the Super Bowl.

"This year’s projection is flat compared to 2023, with USDA reporting chicken production levels are slightly down from last year and wing stocks in cold storage down 13% in November compared to the year prior. This could explain the higher demand and thus the higher wholesale prices we are seeing on wings. At the retail level, fresh chicken wing prices are down approximately 5%, and frozen wing prices are down 11% compared to January of 2023, according to Circana data."

At Wings Over here in State College, 50 wings will cost you $68. At Buffalo Wild Wings in King of Prussia, a similar price of $67.  Remember to pre-order your wings as many establishments will run out of supply.

If one wishes to cook their own wings, food safety is a must ensuring that the internal meat has reached a temperature of 165F.  Nothing worse than a raw, rubbery chicken wing.  USDA provides some alternate cooking methods (below).

Raw Milk from Central PA Dairy Linked to Over 10 Cases of Campylobacter Infection

There have been more than 10 reported cases of Campylobacter infection linked to the consumption of raw milk from a Pennsylvania dairy, Conoco View Dairy in Blain, PA.  The dairy distributes milk to about 5 counties in central PA.  From this report, "Although the source of the bacteria has been determined, the Department of Agriculture said specific production dates could not be identified, meaning consumers should throw away all Conoco View Dairy products regardless of how recent the purchase was."

"Individuals infected with Campylobacter typically experience loose, watery stools accompanied by a fever, nausea, vomiting and stomach cramps — usually within two to five days after consuming the tainted products — the release said."

A top-notch researcher with USDA ARS in Athens GA, he was a bigger-than-life personality that captured the attention of the room as soon as he entered.  He has published a extensively (close to 400 papers are on Reseachgate), primarily focused on pathogens that are associated with poultry.

Dr. Nelson Anthony Cox Jr., an award-winning research microbiologist who spent his career helping to protect the safety of the nation’s food supply, died on Thursday, January 25, 2024. He was 81 years old. Dr. Cox spent over 50 years as a research microbiologist working with the USDA-Agricultural Research Service, where he was one of the first young scientists hired to the staff of the Russell Research Center in Athens, Ga. Since retiring in 2022, he has split his time between Athens and Cary, North Carolina.

FDA Issues Updated Appendix 1, Part of the Hazards Guidance Document

FDA issued the updated Appendix 1 of their Hazard Analysis and Risk-Based Preventive Controls for Human Food: Draft Guidance for Industry document.  Appendix 1 is the  Known or Reasonably Foreseeable Hazards (“Potential Hazards”), a tool to help assist companies conducting the hazard analysis as part of preparation of the hazard analysis.  Table 1 of this appendix lists biological hazards and Table 2 lists chemical hazards.  In the previous version there was a table 3 that looked at process related hazards, but this aspect is now just listed in text.
