Salad Kit Recalled After Wrong Topping Kit (with Different Allergens) Was Added

Dole Fresh Vegetables, Inc. is voluntarily recalling a single lot code of Dole™ Endless Summer Salad Kit.  This recall is due to possible undeclared allergens (fish and egg) in Dole™ Endless Summer Salad Kit. The dressing and topping kit (masterpack) designed for a different Dole product was unintentionally used during a portion of the production of the salad.

It seems we have seen a good many recalls of these kits where the wrong topping pack was inserted.

Banana Muffin Recalled for Undeclared Milk After Analysis by State Laboratory

Hong Thai Foods Corp. of Brooklyn, NY is recalling its 220 grams/7.76 ounce packages of Golden Boy Custard Muffin Banana because they may contain undeclared milk allergens.  The recall was initiated after routine sampling by New York State Department of Agriculture and Markets Food Inspectors and subsequent analysis by Food Laboratory personnel revealed the presence of undeclared milk allergens in the 220 grams/7.76 ounce packages of Golden Boy Custard Muffin Banana which did not declare a milk ingredient on the label.

Oatmeal Recalled After Consumers Finds Almond in Product Where Almonds Not on Label.

think! and Interpac Technologies, Inc., of Woodland, California, a supplier of certain think! brand oatmeal products, have issued a voluntary recall on specific lots of think! Protein + Fiber Oatmeal, Farmer’s Market Berry Crumble products which may inadvertently contain undeclared tree nuts, including almonds and pecans. The recall was initiated following a report from a consumer of finding a piece of almond while consuming the product, and it was discovered that products manufactured in the same lot may contain undeclared almonds or pecans. Subsequent investigation indicates the problem was caused by an inadvertent error in the production process.

This appears to be a line clean-out issue.  The company needs to 'think' about how to verify proper clean-out is accomplished between runs of product, especially when non-allergen product is produced after product containing nuts.  (Actually, they need to do more than 'think' about it, but implement procedures.

Yellow Peas Recalled For Soy Allergen Which Resulted After Mix-up with Soybeans

Maine Grains, Inc. of Skowhegan, Maine is recalling 2,000 pounds of Organic Yellow Peas sold between 10.17.2019 and 11.1.2020 because it may contain undeclared soybeans.   The recall was initiated after it was discovered that organic soybeans of very similar size, shape and color to organic yellow peas were mistakenly shipped by a farmer supplier to Maine Grains, Inc. and were used to fulfill orders of organic yellow peas.

Investigation of E. coli Outbreak Associated with Leafy Greens Comes to an End with Only One Positive Environmental Sample Found

FDA closed the investigation of an E. coli O157:H7 outbreak related to leafy greens that was reported back in October of 2020 by the CDC.  The outbreak which affected 40 people in 19 different states and was officially ended in December of 2020 was linked to leafy greens form Salinas, CA, however an intense investigation failed to identify the specific source.  The only significant finding -  "the outbreak strain in a sample of cattle feces collected on a roadside about a mile upslope from a produce farm.

Insects as Food in the Future - Allergens for Some May Be a Concern

In a recent study, researchers investigated the allergen concerns with insects.  Insects are consumed in many parts of the world, and many view them as becoming a bigger component of our diet in the future.  There are many start-ups in the US focused on developing food products using bugs, and in the EU, the European Food Safety Authority (EFSA) just approved golden mealworms safe for consumption.

But because insects are related to crustacean shellfish, there would be similar allergen concerns.  “Shellfish allergies affect up to three per cent of people globally, but varies according to age and region, and there’s a good chance that people allergic to shellfish will also react to insects.”

Allowable R&D Tax Credits Can Help Fund Your Technical Projects and Programs

 I recently attended a recent seminar by Leyton, a group that provides support for companies to take advantage of R&D Tax Credits.  R&D tax credits were established by the Federal government to promote technical innovation and development within industries such as the food industry.  The Federal R&D tax credit has a start up and small business provision which helps to offset FICA for annual payroll taxes.  And some states also offer some form of the R&D Tax credit, so companies can actually get both Federal & State Tax credit  

I came to see that many technical / food safety projects and programs that food companies are looking to implement could potentially be written off from taxes allowing companies to better afford and support these initiatives.   For example, it may be possible to deduct expenditures as a company implements a third audit compliance system, develops a pathogen monitoring program, or installs IT-intensive traceability systems.  Allowable expenditures could include staffing, consultants, equipment, and supplies.

There are certain criteria that must be met to qualify, but I think it is worth investigating if you or your company are considering or planning to improve your company’s capabilities.  I was not aware of this potential tax deduction, and my guess, your financial people may also not be aware.

Popcorn Recalled for Milk Allergens when Cheddar Flavored Labeled as Butter Flavored

Bickel’s Snack Foods, Inc. is recalling one specific lot of 8 oz. bags labeled as Butter Flavored Popcorn were filled with cheddar flavored popcorn. The error resulted in a undeclared milk being present.  But wait, wouldn't butter flavor have milk allergens just like the cheddar flavored popcorn?  Not, the butter flavor is just the flavor chemicals and oil, not real butter.

Single-Serve Coffee Cups Recalled After Allergens Left Off the Packaging

Door County Coffee & Tea Co of Sturgeon Bay, WI, is recalling its 5.1 ounce packages of French Vanilla Flavored Cappuccino Single Serve Cups because they may contain undeclared Milk and Soy.  The recall was initiated after it was discovered that product contains Milk and Soy was distributed in packaging that did not reveal the presence of these allergens. Subsequent investigation indicates the problem was caused by a printing omission on the packaging.

As a control to prevent this type of issue, incoming packaging should always be reviewed for label content, including allergen correctness.

Frito-Lay today issued a recall for 50 bags of 13 1/2 oz. “Party Size” bags of Ruffles Original Potato Chips because after it was discovered that the 50 bags of Ruffles Original Potato Chips were inadvertently filled with potato chips of another flavor and thus had an undeclared allergen, in this case, milk.

You may 'recall' that last month, Frito Lay received a Warning Letter from FDA for  poor allergen control procedures that had resulted in two allergen-related recalls.

Raw Pork Sausage Product Recalled After Complaints for Foreign Material in Form of Red Rubber Pieces

Bob Evans Farms, Inc. (“Bob Evans”), a Xenia, Ohio establishment, is recalling approximately 4,200 pounds of pork sausage product that may be contaminated with extraneous materials, specifically thin blue rubber.  The raw, pork sausage item was produced on December 17, 2020.  The problem was discovered when Bob Evans notified FSIS that they received consumer complaints.

Two Companies Recall Butternut Squash Products Due to Listeria

Pero Family Farms Food Company, LLC of Delray Florida and Lancaster Foods LLC of Jessup MD are recalling Butternut Squash products due to Listeria.  There is no information on how the Listeria presence was detected.  The two recalls are probably related, but there isn't any further information on how.  The Pero Family Farm recall notice does state that the butternut squash was purchased through a distributor Race West Company, of Clarks Summit, PA.

Reusable Takeout Food Containers?

An article in Fast Company discusses the use of reusable packaging for takeout food by the NY delivery service DeliverZero.  Basically the food comes in a reusable polypropylene containers that are returned through the delivery service.  The customer can hold the container for up to 6 weeks to return or they are charged $3.25.

From a food safety and quality perspective, there can be many concerns...containers not adequately cleaned, containers used to store things that are not food grade with the potential to leach into the plastic, the plastic absorbing odors, the plastic being marred by acid foods like tomato products during reheating, etc.  Then one has to wonder about the costs going into recycling containers...gas for vehicles used in collecting the containers, costs of cleaning, costs for culling out bad containers, and at the end, you still have plastic.  I guess I would prefer a compostable container.

It was pointed out to me that another challenge is getting the customers to understand what they are to do with the reusable containers - that it needs to be returned, how returns occur, preparation steps such as washing or rinsing, etc.

Beef Jerky Recalled Due to Missing Allergen on Label

USDA FSIS issued a public health alert for ready-to-eat (RTE) beef jerky products due to misbranding and an undeclared allergen in that the product contains anchovies, an fish allergen, which is not declared on the product label.  "The product labeled as “CHARLIE BROWN FARMS PREMIUM BEEF JERKY Original Prime Rib” contains Worcestershire, which is not listed as an ingredient, but was utilized in the product formulation."

Chocolate Products Recalled After Customer Complaint for Foreign Object - Brittle Plastic

Lake Champlain Chocolates (LCC) is issuing a public alert and a voluntary recall on select LCC milk chocolate products after a consumer reported finding brittle plastic pieces in a finished product.  This company's products are normally packed as part of the variety within gift packages, boxes and baskets  There is a set range of products which can be determined through best-by date range (but being in a variety pack may make this difficult.)  There was no reason listed as to where the plastic may have originated.

Pet Food Company Expanding Aflatoxin-related Recall, FDA Issues Alert Stating Over 70 Reported Pet Deaths

FDA issued an Alert regarding pet food from Midwestern Pet Foods after more than 70 reported dog deaths and 80 cases of pet illness.   Midwestern Pet Foods is expanding its initial recall (Dec 30) to now "include all dog and cat pet food products made with corn products because those products may contain aflatoxin levels which exceed acceptable limits."

"Aflatoxin is a toxin produced by the mold Aspergillus flavus, which can grow on corn and other grains used as ingredients in pet food. At high levels, aflatoxin can cause illness and death in pets."

The product was produced in their Oklahoma processing facility.

Plant-based Yogurt Recalled After Testing Indicates Mold Issue

EVR Foods, INC, parent company to Lavva, is recalling one lot of its Blueberry Plant-Based Yogurt (expiration date 2/21/21) after testing indicated potential mold contamination. . 

This is a plant-based yogurt made from a pili nut (also known as also known as Pacific almonds or kenari nuts) which is high in fat, both saturated and monounsaturated.  Most similar to macadamia nuts.  The nuts are from the south Pacific (Australia, Papa New Guinea and South East Asia).

Canada - Mushrooms Recalled Due to Clostridium botulinum

The Canadian Food Inspection Agency (CFIA) issued a recall for Belle Grove whole white mushrooms 
 "because they may permit the growth of Clostridium botulinum".   While the title state the 'presence' of Clostridium botulinum, the text states that the 'product presents the opportunity for growth'.  

The CFIA statement does not go into any detail on the issue.   In terms of risk, the mere presence is not an issue.   Clostridium botulinum spores may be present in this natural product, but the concern would be growth of the organism, during which, toxin can be formed.   C. botulinum requires an anaerobic environment for growth, that is, an environment that has low oxygen levels.  To prevent this in mushrooms, the containers are perforated to allow air to exchange into the container.  So while not exactly stated, one would guess that the mushrooms were packaged in plastic overwrap without that plastic being perforated (no holes).

Ice Cream Product Recalled After Customer Finds Metal Filler Equipment Part

Weis Markets today said it has issued a recall for: 10,869 containers of Weis Quality Cookies and Cream Ice Cream (48 oz.), and 502 bulk containers of Klein’s Vanilla Dairy Ice Cream after "one report of a customer who discovered an intact piece of metal equipment in the Weis Quality Cookies and Cream Ice Cream (48 oz). There is concern of an additional piece of equipment present in the ice cream product(s) possibly presenting a choking hazard."  Product was distributed in 7 states - Pennsylvania, Maryland, Virginia, New Jersey, New York, Delaware and West Virginia.

USDA FSIS issued a Public Health Alert for Chicken Enchilada products after a retail employee found a labeling issue.  The product was sold through HyVee retail stores in eight midwestern states.  The product is a NRTE product and thus requires cooking, and past its stated shelf-life date.  Because of this, USDA FSIS issued an alert rather than a recall in the event someone had frozen the product.

Mislabeled Product - Salad Packed with the Wrong Dressing/Topping Pack

Dole Fresh Vegetables, Inc. is recalling a limited number of cases of Dole™ Sesame Asian Chopped Salad Kit because the wrong dressing and topping kit (masterpack) was unintentionally used during a portion of the production of the Sesame Asian Chopped Salad.  In short, the dressing/topping kit used had egg  which did not match the salad being produced.  As stated in the release, only a portion of the production run was affected, so someone grabbed the wrong packets and control checks did not catch the mix-up.

Report on Persistent Listeria Contamination Issue in a Swiss Cheese Facility

An article published in Emerging Infectious Diseases titled Listeriosis Caused by Persistence of Listeria monocytogenes Serotype 4b Sequence Type 6 in Cheese Production Environment discusses an ongoing Listeria outbreak in Switzerland that occurred in two waves, 2018 and 2020.
"Of the 34 human isolates, 30 were from blood samples and 1 each from an abscess, ascites, maternal placenta tissue, or stool sample (Table). One case of perinatal transmission and 10 deaths (29%) were reported."

A Swiss cheese manufacturer had reported the detection of Listeria monocytogenes in the facility and this was matched to the outbreak strain using whole genome sequencing.  "These findings prompted extensive environmental sampling on the production site of the manufacturer. A total of 50 swab specimens from locations, such as vats, cheese harps, skimming devices, sink drains, brushes, scrub sponges, trays, door handles, ripening cellar floors, and walls were obtained....L. monocytogenes was identified in 11 (22%) of 50 environmental samples, and all 5 sequenced isolates matched the outbreak strain CT (Table; Figure 2). These results lead to a recall on May 5, 2020, of 26 items, including brie, sheep and goat cheese, and organic cheeses; production was stopped immediately. " 

In conclusion, the report states "This outbreak highlights the risk for recontamination of pasteurized cheese products during manufacturing and emphasizes the need for routine sampling of products, manufacturing equipment, and the production environment. Routine quality controls should include WGS typing of environmental L. monocytogenes isolates to enable early recognition of potential food contamination and to ultimately mitigate the risk for listeriosis."

Proposal to Remove Standard of Identity for Frozen Cherry Pie

 A few weeks back, we discussed the push to remove the Standard of Identity for French Dressing.  There is also a proposal to remove the Standard of Identity for frozen cherry pie.  Posted in the Federal Register, the proposal looks to revoke the standards for cherry pie by a citizens petition from the ABA - the American Baking Association.  The reasoning is that  "frozen cherry pie is the only fruit pie, either frozen or non-frozen, that is subject to standards of identity and quality" and that it limits what a baker can do with this pie, but not with other pies, including non-frozen cherry pies.  And since we have not had issues with other pies regarding a standard over time, then removing this should not result in a cascade of deception involving frozen cherry pies in the market.

There is probably a history of why this specific standard was written in the first place.  Perhaps devious bakers were making low quality cherry pies and offering these at a lower price compared to the price for higher quality frozen cherry pies and the quality bakers complained.  Perhaps a baker was producing pies at a lower price by using bruised cherries.   Or perhaps there was a consumer complaint from people who felt duped because they bought a frozen cherry pie with little or no cherries.  Can this issue still arise?  Sure, but as consumers, we would be unlikely to buy a lower quality pie at an unreasonable price.  We may not really care if the cherries have bruises.  Consumers will have the choice of the frozen pie brand they purchase based upon price and the quality they expect.

FDA Warning Letter Issued to Texas Importer of Frozen Sliced Strawberries for Lack of FVSP

A Texas based importer was issued a Warning Letter by FDA for not being in compliance with the  FSVP requirements for Frozen Sliced Strawberries   The company had not identified or evaluated biological, chemical or physical hazards potentially present before your suppliers load the products.  There were no established  and written procedures to ensure that  import foods only come from foreign suppliers previously approved based on evaluation conducted to determine a foreign supplier’s performance and the risk posed by the food,  The company did not establish and follow written procedures for ensuring that appropriate foreign supplier verification activities are conducted with respect to the imported foods.

Pet Food Recalled for Elevated Levels of Aflatoxin.

Midwestern Pet Foods, Inc., of Evansville, IN is issuing a voluntary recall of the below listed dog and cat food products due to tests indicating levels of Aflatoxin that exceed acceptable limits.  Aflatoxin is a toxin produced by the mold Aspergillus flavus, which can grow on corn and other grains used as ingredients in pet food. At high levels, aflatoxin can cause illness and death in pets.  There have been reports of illnesses and deaths in dogs associated with the below listed lots of Sportmix High Energy.  There are reports of at least 28 deaths and 8 illnesses.

With dry pet foods, corn is often the source of aflatoxin.  This occurs when the corn used in processing the pet food had mold growth prior to harvest.  Processors normally do extensive testing of incoming corn.   Suppliers of the corn will do their own testing as well plus will track crop conditions that can lead to mold growth.  There are tolerances for low levels of alfatoxin - 20ppb for corn to be used for pet food.
